Corruption

The National Anti-Corruption Mechanism (MENAC) and the General Anti-Corruption Prevention Regime (RGPC) were approved by Decree-Law 109-E/2021, highlighting the importance and need to prevent, detect and repress corruption, and as a result of the National Anti-Corruption Strategy 2020-2024.

For the purposes of the RGPC, corruption and related offenses are defined as the crimes of corruption, undue receipt and offer of advantage, embezzlement, economic participation in business, concussion, abuse of power, prevarication, influence peddling, money laundering or fraud in obtaining or diverting a subsidy, grant or credit.

The GPCR makes it compulsory for organizations with more than 50 employees to apply various corruption prevention measures, and they must adopt and implement a Compliance Programme that includes at least a Plan for the Prevention of Risks of Corruption and Related Offences (PPR), a Code of Conduct, a Training Programme and a Whistleblowing Channel, as well as appointing a Compliance Officer for Anticorruption.
